General Terms and Conditions – Pixs Visuals
Pixs Visuals is officially established in Veldhoven and registered with the Chamber of Commerce under number 87240513.
These general terms and conditions apply to all agreements between Pixs Visuals and the client.
They also apply to all obligations arising from agreements concluded at a later stage between the parties, as well as any other legal relationships.
Furthermore, they apply to all obligations resulting from actions performed in connection with such agreements.
Quotation
Pixs Visuals prepares quotations based on an estimate of the required working hours for project preparation.
Pixs Visuals determines these hours reasonably and in good faith.
However, it may occur that during the project the client requests additional work that results in extra hours and costs not included in the original quotation. These additional hours will be charged based on a fixed hourly rate, on top of the agreed quotation amount, unless otherwise agreed.
All quotations are inclusive of 21% VAT.
Quotations are valid for 2 months from the date of issue.
Travel & Accommodation
Travel and accommodation costs will be charged.
The first 15 kilometers are free of charge. Any travel beyond this distance will be charged separately and calculated in advance.
Travel costs are €0.30 (including VAT) per kilometer.
Cancellation
In case of cancellation between 4 and 6 days before the agreed date, 20% of the agreed amount will be charged.
In case of cancellation less than 2 days before the agreed date, the client is liable to pay the full agreed amount to Pixs Visuals.
Illness
If Pixs Visuals is unable to carry out the assignment due to illness or physical injury, Pixs Visuals cannot be held liable for any damages or costs incurred.
Pixs Visuals will inform the client as soon as possible.
Any deposit paid will be refunded within 8 days.
Nature of the Assignment
Pixs Visuals excludes any liability for missed or unrecorded footage.
Despite experience and best efforts to meet all expectations, Pixs Visuals cannot guarantee that all requested moments or requirements can be captured in photo and/or video, due to the nature of the work.
Technical Issues
Pixs Visuals will take all reasonable measures to minimize technical issues.
In case of such issues, Pixs Visuals is not liable for any (financial) damages.
If Pixs Visuals is unable to deliver the material/product due to technical problems, the client is not required to pay for the assignment.
Force Majeure
In cases of force majeure, including but not limited to external causes such as fire, theft or defective memory cards, Pixs Visuals cannot be held liable.
Image Selection
Image selection is carried out by Pixs Visuals.
Digital files will be delivered in the agreed format via email, USB or other agreed digital means.
Approval of Work
If the client wishes to request changes, this must be communicated within 5 days after delivery.
If no request is received within this period, Pixs Visuals assumes the delivered work is approved.
Music Licensing & Publication Costs
The client is responsible for any publication costs, including costs related to music usage when publishing video content.
Copyright
Pixs Visuals retains copyright of all produced material.
Pixs Visuals is allowed to use the content for its own promotional and business purposes.
The client is allowed to use the material for private purposes, unless otherwise agreed.
Liability
Except for legal obligations, Pixs Visuals shall never be liable for any damages payable to the client or third parties.
Pixs Visuals is not liable for consequential damages, business damages, direct or indirect damages, including but not limited to loss of profit or operational loss suffered by the client or third parties.
The client indemnifies Pixs Visuals against any claims from third parties related to the execution of the agreement, unless prohibited by law.
